Juli 2011 hat die Frage nach einem gesetzlichen Schutz von Whistleblowern erneut an Aktualität gewonnen: Die Kündigung einer Altenpflegerin, die auf Missstände bei der Patientenversorgung hingewiesen und gegen ihren Arbeitgeber Strafanzeige erstattet hat, verstößt nach Ansicht des Gerichts gegen die Meinungsfreiheit. In Deutschland ist die gegenwärtige Rechtslage für Personen, die im öffentlichen Interesse auf arbeitsplatzbezogene Missstände aufmerksam machen, unbefriedigend und eine Klärung im Interesse der Rechtssicherheit erforderlich. Die Arbeit vergleicht die englische und U.S.-amerikanische Rechtslage zum Whistleblowing und arbeitet die wesentlichen Kriterien eines umfassenden Schutzes heraus. Sie endet mit einer Bewertung des im Jahr 2008 eingebrachten Gesetzesentwurfs sowie einem eigenen Lösungsvorschlag.
