Durch solche steuerlichen Maßnahmen wird nämlich nur ein kleiner Kreis der Unternehmen des Mitgliedstaats begünstigt, so dass das Merkmal der Bestimmtheit des Art. 87 EG auf dem ersten Blick erfüllt zu sein scheint. Dass diese Folgerung nicht immer richtig ist, erläutert der Autor ebenso wie die Frage, ob ein unterdurchschnittlich niedriger Gewerbesteuersatz einer deutschen Gemeinde der europäischen Beihilfenaufsicht unterfällt.
